Payable By separate Irrevocable Operative documentary Letter of credit at sight issued by
Primaries China/Hong Kong Bank(s) and transferred by HSBC to the seller covering 100% total
amount of this contract shipmentbut within first shipment until to after 15 days of delivery
date,if the buyer can not issue/transfer the second shipment L/C,the seller have right to change
price.
After signing this contract by both parties, Buyer shall issue/transfer non-operative L/C to seller within 10 banking days. Within 5 banking days, if the contents of L/C is acceptable by the seller,the seller shall issue an Irrevocable , transferrable,Unconditional , on demand ,Acceptable SBLC(STANDBY LC SUBJECT TO ISP98)/ PERFORMANCE BOND.via a AAA bank, which is equal to 2% L/C value to buyer or buyer appointed beneficiary(the benificiary's bank information will be advised while L/C issued/transferred).Sellers Bank will confirm SBLC/ PERFORMANCE BOND upon which the Irrevocable Letter of Credit will be operative automatically and unconditionally.. The bond shall carry a cash value equivalent to the total value of 60000 Metric Tons at US$XX/MT is US$XX (SAY US DOLLAR FOUR HUNDRED SIXTY THOUSAND AND EIGHT HUNDRE).
Within 80 days after the seller's bank acknowledges the operative L/C is issued by buyer's bank if the seller fails to deliver the good to buyer's destination, in this event, the seller's SBLC/PERFORMANCE BOND amounting 2% of contract value will be drawn into the buyer's account automatically.
